Of Counsel Michael Magotsch, head of BCLP’s Frankfurt Employment Team, authored a bylined article published Sept. 12 by WirtschaftsWoche on an important ruling of the federal labor court regarding video surveillance of employees in Germany. The court ruled that companies are entitled to use information gathered by legitimate video surveillance in court as evidence for wrongdoings of the employee to support an extraordinary termination of the employment contract. Magotsch underlines, however, that this does not open the gate for “big brother” surveillance at the workplace.
