Frankfurt Of Counsel Michael Magotsch authored an article May 10 for WirtschaftsWoche online concerning the opinion of the Advocate General at the European Court of Justice (ECJ) regarding pending litigation before the Berlin courts to determine whether the German Co-Determination Act violates EU law. Magotsch argues that provided the ECJ follows the Advocate General, German employee representation on the board level does not violate EU law and may be restricted to employees in Germany. In the case of a different ruling by the ECJ, corporations in Germany would be obliged to review existing or to create new supervisory boards and appoint employee representatives according to the size of their international workforce.
