Colorado Springs Partner Steve Smith and Associate Suzanne Crespo published an article in the July issue of SportsTravel Magazine providing pointers for event organizers to recognize and avoid potential issues when using an athlete’s name or likeness for commercial purposes.  When contemplating the usage of an athlete’s image, they advise to know how the image is going to be used and understand what is its commercial purpose, obtain consent from athletes and participants up front through a contract provision or release form, and clearly define expectations relating to usage of athlete images and likeness when contracting with third parties. “More than anything, it is important to be aware of what rights you, as an organization, have to the name and likeness of people participating in your events, and to think ahead to what rights you want or need when contracting with them,” they wrote.
