Peter focuses on complex commercial and intellectual property litigation, including cases involving contracts, economic torts and product liability issues as well as telecommunication and intellectual property disputes.

A successful trial lawyer with broad “first-chair” experience managing and trying multimillion dollar litigation matters, he has won cases before juries and judges in federal and state courts throughout the United States.  Peter’s verdicts include victories involving high-profile corporate disputes for companies in telecommunications, real estate and other areas of business.  Successful before  the Colorado Court of Appeals involving novel issues of Colorado statutes, he has also tried arbitrations between large telecommunications companies.

His litigation counseling, trial and related work often involves antitrust, patent, unfair trade practices.  Peter’s work often focuses on banking, mortgage fraud and environmental litigation involving technology, engineering and banking companies as well as telecommunications clients.

Peter has also implemented and upgraded litigation support and practice-management techniques for litigation teams he’s led, helping entire teams and practices deliver streamlined, ever-more efficient legal services.

Prosecution and defense of several noteworthy CenturyLink, Inc., (f/k/a Qwest Communications Int’l, Inc.) matters involving intellectual property, software licensing, consumer class actions, and privacy disputes, including:

  • Serving as lead counsel for Qwest in pending putative consumer class actions involving alleged false advertising and consumer protection violations relating to high speed internet sales and the validity of Qwest’s arbitration clause and class action waiver (Colorado, Washington, and Florida)
  • Serving as lead counsel for Qwest in action by Boulder County Safehouse involving alleged breach of privacy agreement and negligent directory listing, resulting in favorable ruling on summary judgment
  • Successfully representing Qwest in Bell Atlantic v. Twombly
  • Successfully defended Qwest in directory listing matter brought by providers of cellular service resulting in favorable jury verdict following two-week trial
  • Serving as counsel for Qwest in two-week arbitration against Media One involving $50 million contractual dispute over corporate separation agreement

  • Serving as lead counsel for Swedish 3D optical semi-conductor company in pending international arbitration against Microsoft involving licensing and intellectual property dispute over 3D time-of-flight technology (London, England)

  • Serving as lead counsel for WFO Imports in defending patent litigation brought by Human Touch involving patented massage chairs leading to favorable jury verdict following three-week trifurcated trial (California)

Prosecution and defense of antitrust related disputes, including:

  • Serving as lead counsel for Qwest in actions filed by CLECs alleging misuse of essential facilities and antitrust violations (Colorado and New Mexico)
  • Successfully defending Coach USA, a transportation company, in an antitrust case alleging price fixing brought by hotel concierges (California)
  • Successfully defended Trans-Canada Pipeline in a gas transportation antitrust case brought by Paladin, a gas marketer, alleging price fixing (Montana)

Lead counsel for major mortgage and securities fraud-related matters on behalf of banks and federal receiverships, including:

  • Serving as lead counsel for the SEC-appointed receiver of Mantria Corporation and its affiliates involving $39 million fraud committed against investors in nationwide Ponzi scheme, as well as for receiver’s pending third party action against attorneys and accountants implicated in the scheme
  • Serving as lead counsel for Flagstar Bank against First Collateral Services, a subsidiary of CitiGroup, involving $30 million mortgage fraud perpetrated on Flagstar, resulting in a favorable settlement on eve of trial (Colorado and Texas)
