Joe Richetti is a Co-Leader of the firm’s Intellectual Property Client Service Group. Mr. Richetti focuses his practice on intellectual property disputes, including patents, unfair competition, and misappropriation of trade secrets.  He has litigated more than 60 IP cases representing clients in district courts throughout the United States, as well as at the U.S. Court of Appeals for the Federal Circuit. Mr. Richetti has also represented clients in more than 100 post grant proceedings at the United States Patent and Trademark Office, including Inter Partes Review proceedings and ex parte reexaminations. Mr. Richetti also assists clients with licensing, right-to-use and infringement studies, validity and enforceability review, due diligence for the purchase or sale of intellectual property assets, and management and development of patent portfolios.

Mr. Richetti represents clients across a broad range of technologies, including: wireless communication systems (such as Bluetooth, WiFi, and RFID), smart phone technology, touch screen devices, MEMS devices, paging and cellular systems, modems, computer networks, internet-related technologies (such as E-commerce, websites, authentication systems and online advertising), computer hardware and software (such as microprocessors, flash and non-volatile memory, operating systems and mobile-phone applications), remote and virtual back-up systems, gaming, linear and digital integrated circuits, semiconductor technology, pre-paid cards, avionics equipment, HD Radio, GPS-related technology, car stereos and electric motors.

Mr. Richetti’s undergraduate degree is in electrical engineering.

Representative Experience

  • Innovative Solutions and Support, Inc. v. J2, Inc., et al. (W.D. Tenn.) Represented plaintiff, Innovative Solutions and Support, Inc., in patent infringement and trade secret case related to aircraft computers.  Obtained a judgment for the client in excess of $24 million, including attorneys' fees.
  • Netscape Communications Corp., v. ValueClick, Inc. et al. (E.D. Va.) Represented the defendant, a provider of online advertising services, against allegation of infringement of U.S. Patent 5,774,670, which is commonly referred to as the “cookie” patent in the Internet field.  Our efforts led to the invalidation of the independent method claim and the dismissal of allegations of willful infringement on summary judgment.
  • Acco Brands, Inc. v. Belkin, et al. (E.D. Tex.) Successfully defended Belkin in a patent infringement case through two jury trials in the Eastern District of Texas and an appeal to the Federal Circuit.  Three patents related to computer locks were asserted, one patent was dismissed on summary judgment, another claim was dismissed by JNOV after trial, and the third claim was dismissed after an appeal to the Federal Circuit.
  • Firepass IP Holdings, Inc. v. The Boeing Company (E.D.N.Y.) Defended The Boeing Company against claims of infringement of several U.S. Patents relating to fire suppression systems for aircraft.

  • Represented Symantec Corporation in Veeam Software Corporation v. Symantec Corporation, Case No. IPR2013-00144, IPR2013-00145, IPR2013-00151.  Decisions entered denying institution of Inter Partes Review.
  • Represented Aylus Networks, Inc. in Apple Inc. v. Aylus Networks, Inc., Case No. IPR2014-01566.  Decision entered denying institution of Inter Partes Review.
  • Represented Veritas Technologies LLC in Veeam Software Corporation v. Veritas Technologies LLC, Case No. IPR2014-00090.  Decision entered granting Veritas Technologies’ Motion to Amend.
