Brent Vincent’s practice focuses on environmental law, insurance law and litigation. He has significant experience litigating insurance coverage, condemnation, toxic tort, cost recovery, products liability and land use matters. He also counsels clients on insurance and eminent domain issues, as well as on environmental regulatory issues and the environmental aspects of real estate and corporate transactions.

  • Insurance Coverage Litigation: Obtained coverage for toxic tort suit, despite presence of absolute pollution exclusion, in nationwide case of first impression on the impact of a Title V permit on insurance coverage.
  • Insurance Litigation/Recovery: Representation of clients seeking insurance coverage for environmental (and other) claims and liabilities, including litigation of declaratory judgment actions.
  • Toxic Tort/Class Action Defense: Defeated certification of a putative class action alleging air pollution and odor nuisance.
  • Eminent Domain: Representation of property owners, condemning authorities, tenants and lenders in litigation and negotiations related to the necessity and valuation of land takings.
  • Superfund Defense: Representation of PRPs at Superfund Sites and in related litigation matters.
  • Insurance Coverage/Product Liability: Represented a major retailer in obtaining insurance coverage for liability claims related to a commercial fire. Defended and prosecuted products liability actions related to the fire.
  • Toxic Tort Defense: Defense of toxic tort suit alleging widespread groundwater contamination from VOC plume.
  • Environmental Cost Recovery: Representation of municipal entities and private parties seeking recovery of environmental remediation costs from historic land owners.
