David Père, counsel in Bryan Cave Leighton Paisner’s Paris office, was interviewed Sept. 17 by La Lettre des Juristes d'Affaires (LJA) regarding the evolution of the notion of legal privilege in the United Kingdom. In its Sept. 5 decision, the Court of Appeal of England and Wales considered that the documents prepared by a solicitor, as part of an internal investigation requested by a group in anticipation of an investigation by the Serious Fraud Office (SFO), are protected by legal privilege. Père analyzed this judgment, which will have a strong impact in the UK on companies facing suspicions of fraud and corruption. “In the UK, the renunciation of legal privilege is synonymous with good faith,” he said. “Despite this decision, it is certain that many companies will continue to give it up.”
