Martin Lüderitz, Counsel in BCLP’s Hamburg office, commented in an article in WirtschaftsWoche Online published 6 November on the ruling of the European Court of Justice on compensation for unused holidays. According to the ruling, even if no application for a paid annual vacation has been made, financial compensation may be due when the employee leaves the company. Employers have to observe this new legal standard. Lüderitz points out that employers must take the necessary precautions if they do not want to have to accept paid holidays under all circumstances.
