Hamburg Counsel Dr. Martin Lüderitz was interviewed by Börsen-Zeitung on June 23 commenting on the advocate-general’s opinion regarding the upcoming ECJ ruling on compensation for unused holidays. Lüderitz pointed out that following the opinion employers could not rely on previous legislation that employees have to ask for annual vacation, otherwise losing their claim when they fail to do so. Employers were obliged to take precautions if they do not want to have to accept paid holidays under all circumstances. Otherwise, employees had a right to be compensated for untaken holidays, e.g. when they leave the firm. Click here to read the interview (in German).
