Dallas Partner Keith Aurzada, Atlanta Partner Ryan Pumpian, Atlanta Associate John Bush and Santa Monica Partner John Amberg were noted Aug. 20 in IPLaw360 for representation of electronic medical records software company eClinicalWorks in a lawsuit accusing it of infringing on the medical patient flowsheet patent held by the notorious patent troll Uniloc Luxembourg SA. A California federal judge tossed Uniloc’s lawsuit, saying Uniloc couldn’t get its case to a jury because its direct infringement allegation was speculative, and there was no evidence to support its indirect infringement claims involving eClinicalWorks’s customers. Quoting from Pumpian’s oral argument during the summary judgment hearing, the article stated that eClinicalWorks “agreed with the tentative ruling because the evidence is simply lacking. [The plaintiffs are] still just hypothesizing that infringement could have happened.”
