Hong Kong Partner Nigel Binnersley and St. Louis Partner Mark Leadlove authored an article Dec. 1 in Law360 on varying views of legal professional privilege. Binnersley and Leadlove reviewed and compared legal professional privilege in England, Hong Kong, the U.S. and France in light of a recent court decision in Hong Kong. In CITIC Pacific Limited v. Secretary for Justice and Commissioner of Police, the Hong Kong Court of Appeal clarified and upheld the concept of legal professional privilege and distanced itself from the position that is applied in England.
