Discovery often includes more than just the documents intentionally produced from one party to another. New York Partner James Altman will discuss the ethics of inadvertent disclosure and informal discovery at the 8th Annual Labor and Employment Law Conference on Nov. 7.

As a panelist, Altman will explore an attorney’s ethical obligations when engaging in informal discovery or encountering inadvertent disclosure, including whether an attorney has an obligation to return documents, whether he or she may use certain documents, and what disclosures must be made to the other side.

In addition to general commercial litigation, Altman has concentrated a substantial portion of his time on issues of professional liability and legal ethics. He has developed a deep understanding about the professional and legal obligations of lawyers as the result of his active membership on the New York State Bar Association’s (NYSBA) Committee on Attorney Professionalism and Committee on Professional Ethics and on the Departmental Disciplinary Committee of the First Department. He has represented or sued lawyers in malpractice cases, fraud cases, RICO actions, ERISA actions, sanction cases, professional disciplinary proceedings, and disqualification motions.
