Susannah Mitchell has experience with complex civil litigation matters. She has represented parties in litigation under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), California Hazard Waste statutes, the Clean Water Act, the California Porter-Cologne Water Quality Control Act, and California’s Proposition 65. Such representation has included preparation and prosecution of claims for remediation of environmental damages as well as defending against such claims.
Ms. Mitchell also counsels clients on a broad range of environmental regulatory compliance, permitting, enforcement, policy, and remediation issues. She represents clients before a number of governmental agencies, including the California Regional Water Quality Control Boards, California State Water Resources Control Board, California Department of Toxic Substances Control, South Coast Air Quality Management District, and the U.S. Environmental Protection Agency. Ms. Mitchell works closely with environmental and technical consultants on the development of environmental compliance and remediation projects requiring approval by government agencies at both the state and federal levels.
In addition, Ms. Mitchell has worked on Brownfield development projects throughout the State. In this regard, Ms. Mitchell advises clients with respect to project feasibility and due diligence, deal negotiation, voluntary cleanup programs, remediation oversight and consultant management, obtaining environmental insurance, and regulatory approvals.
