Richard Mooney litigates and arbitrates complex commercial disputes throughout the United States and internationally, with a particular focus on transnational disputes and matters involving antitrust and/or intellectual property issues. His antitrust and competition experience includes both providing compliance advice to industry-leading corporations and representing plaintiffs and defendants in disputes involving the Sherman Act, the Clayton Act, the Robinson-Patman Act, California’s Cartwright Act and Unfair Practices Act, EU Articles 101 and 102, and the Korean Monopoly Regulation and Fair Trade Act. His intellectual property experience includes counseling and litigation/arbitration involving trade secret, copyright, and patent disputes, with an emphasis on the relationship between patent and antitrust law. Mr. Mooney’s recent clients include individuals, small companies, and major corporations from throughout the United States and nearly a dozen other countries who he has represented in state and federal trial and appellate courts and in arbitration proceedings before JAMS and AAA. He strives to offer each client thoughtful analysis, sound judgment, aggressive litigation (where appropriate), and close attention to client service.

Mr. Mooney began his career as a judicial clerk for the Honorable Amalya L. Kearse of the U.S. Court of Appeals for the Second Circuit in New York, and then spent 10 years at two of California’s most prestigious law firms before joining a small regional firm that recently combined with Bryan Cave. His pro bono work includes a significant victory before the U.S. Court of Appeals for the Ninth Circuit that halted efforts to weaken the famous "dolphin safe" standard for canned tuna.

  • Representation of an international video game company as first chair in a five week jury trial in Los Angeles Superior Court.
  • Representation of a major online payment network in a major antitrust dispute in the Northern District of California.

  • Representation of a public records search firm in defense of a 42-count complaint alleging copyright, trademark, trade dress, trade secret, cybersquatting, and related claims in the Central District of California and in litigation and arbitration in California and Washington Superior Court of disputes with a major internet portal and a major personal information services firm.
  • Representation of an arts dealer against America's best-selling painter and his company in arbitration before JAMS involving copyright, trademark, and licensing issues.
  • Representation of an international financial services company from Jersey (Channel Islands) in a dispute related to management of investment funds with interrelated lawsuits in federal and state court in California and in the courts of Jersey, England, and Austria.
  • Mr. Mooney's pro bono work has included a significant victory before the United States Court of Appeals for the Ninth Circuit halting Commerce Department efforts to water down the famous "dolphin safe" standard for canned tuna.
