Megan Lennox's practice includes representing clients regarding compliance with federal and state environmental regulatory programs and enforcement defense throughout the country. In particular, Ms. Lennox has assisted clients in resolving regulatory compliance issues under RCRA, CERCLA, the Clean Air Act, the Clean Water Act, OSHA and MSHA. She also has counseled clients on compliance obligations under European Union environmental regulations, including RoHS, WEEE, REACH and similar foreign programs.
Ms. Lennox has served clients in connection with development and implementation of environmental remediation projects, including coordination and management of environmental consultants. She has also counseled clients regarding transactional matters, including environmental due diligence for high stakes mergers and acquisitions, real estate transactions, and lending transactions. Ms. Lennox drafts and negotiates environmental representations, warranties and indemnities, as well as escrow and holdback arrangements in connection with environmental liabilities. She also counsels clients on the procurement of environmental insurance for transactions with potential environmental liabilities.
Ms. Lennox has Arizona and Colorado state and federal court litigation experience with an emphasis on Superfund cost recovery and defense, environmental and commercial insurance coverage claims, and general commercial litigation. In connection with her litigation practice, Ms. Lennox has extensive experience in motion practice and has worked closely with consultants in development of expert testimony, including report preparation, document management, and all phases of discovery. Ms. Lennox also recently handled significant trial responsibilities, including conducting multiple witness examinations, as part of the trial team for a complex federal court jury trial.
Before entering the legal profession, Ms. Lennox was a civil engineer with a focus on environmental engineering and hydrology. She worked as an engineer for a national civil engineering firm and as an environmental consultant for two international environmental consulting firms.
