Mark Brennan’s practice focuses on class action, commercial and products liability litigation matters. He has familiarity with class action matters involving claims under state lending laws, state unfair trade practices acts, the Racketeer Influenced Corrupt Organizations Act, the Truth In Lending Act, the Uniform Commercial Code and common law theories of liability such as fraud, negligent misrepresentation and unjust enrichment. Mr. Brennan’s commercial litigation practice is varied and involves cases in which contracts, warranties, the Uniform Commercial Code and allegations of fraud are at issue. Mr. Brennan’s practice is national in scope; he has participated in the defense of actions brought in Missouri, Kansas, Oklahoma, Texas, Iowa, Illinois, New Mexico, California, North Dakota, Colorado, Wyoming, Florida, New York, Georgia, Kentucky, Ohio, Louisiana, Michigan and Tennessee.

Representative Experience

• Participated in defending H&R Block, Inc. and its subsidiaries in several jurisdictions against consumer class action cases involving claims based on the Truth-In-Lending Act, state unfair and deceptive trade practices laws, usury laws, RICO, fraud, negligent misrepresentation, false advertising and allegations of fiduciary obligations
• Participated in the defense of Credit Acceptance Corporation in a consumer class action case involving multiple claims arising out of the acceptance, servicing and collection of retail installment contracts
• Participated in the defense of a financial institution involving the failure of a $65 million investment.
• Participated in the defense of various commercial entities in several cases involving claims of fraud, misrepresentation, breach of contract, negligence and breach of warranty
• Participated in the defense of numerous products liability and negligence cases in many jurisdictions involving property damage, personal injury and death
• Participated in actions against United States administrative agency challenging practices under federal statutes and regulations
