Litigation Practice
Our group’s litigation team encompasses all types of disputes that affect clients in the life sciences and health care industry. In addition, our attorneys routinely provide counsel to clients on risk management and litigation avoidance strategies. Our team represents clients in all aspects of litigation, ranging from motion practice, oral and written expert and non-expert discovery, trial practice, appellate practice, settlement negotiations and alternative dispute resolution.
Bryan Cave’s litigators have substantial experience at all levels of state and federal courts, as well as arbitration and mediation, and are well situated to protect the interest of life sciences and health care companies. Our team members are seasoned trial attorneys with experience representing clients in a wide range of venues, including state and federal courts throughout the United States, the Centers for Medicare and Medicaid Services, the Office of Hearings and Appeals of the Social Security Administration, the Provider Reimbursement Review Board, arbitration panels, private payor hearings, as well as medical staff peer review hearing panels. A number of our team members have government-enforcement backgrounds, including a former top official in the Justice Department and a former United States attorney.
The litigators in the Life Sciences and Health Care Client Service Group have represented life sciences and health care clients in, among others, disputes over ownership of technology developed pursuant to a collaboration agreement, disputes under patents and patent licenses (see also Patent and Other Intellectual Property Transfers and Protection section above), antitrust and unfair competition disputes (including restrictive covenant enforcement), defense of product liability class action lawsuits, medical staff and peer review controversies, governmental and private payor reimbursement matters, and governmental investigations. Bryan Cave also has significant experience representing pharmaceutical companies with respect to complex tort and class actions.
