Lawrence Gottesman represents special servicers of securitized commercial mortgages, secured and unsecured lenders, creditors’ committees, individual creditors, landlords, bankruptcy investors, debtors and equity security holders in a wide variety of chapter 11 cases and out of court workouts and restructurings, including those involving hotels, single asset real estate partnerships, financial services, retailers and professional partnerships.  He has substantial expertise in restructuring securitized commercial real estate mortgages.  Mr. Gottesman also has broad bankruptcy litigation experience, including litigation of issues relating to use of cash collateral, perfection, priority, confirmation, exclusivity, equitable subordination, substantive consolidation, recharacterization, rejection of collective bargaining agreements, fraudulent transfers and preferences.  He also has commercial litigation experience in non-bankruptcy matters.

Mr. Gottesman’s practice also includes representing parties in transactional matters such as chapter 11 sales, acquisitions of assets from distressed entities and financing transactions.

  • Representation of special servicer and certificate holder in connection with chapter 11 cases of Innkeepers USA Trust
  • Representation of special servicers in connection with chapter 11 cases of Lodgian, Inc.
  • Representation of special servicer in connection with workout of large “tenant-in-common” loan
  • Representation of special servicers of securitized loans in connection with numerous other bankruptcies, workouts and restructurings
  • Representation of secured lender in connection with chapter 11 case of DBSI, Inc.
  • Representation of a secured lender owed in excess of $40 million in connection with the chapter 11 case of a prominent New York City hotel
  • Member of team representing creditors committee of New York investment bank
  • Served as bankruptcy counsel for a home improvement retailer with over $500 million in sales
