Biography

Dan Nester is a leader of the firm’s Illinois litigation practice. He concentrates his practice in the area of commercial, real estate and banking litigation. Mr. Nester advises petroleum refiners, environmental servicing firms, manufacturers and other corporations with respect to toxic tort, environmental, product liability, contract disputes and other litigation. Mr. Nester also counsels lenders in connection with loan originations, workouts, restructurings and bankruptcies. Although his practice includes handling cases in several states and federal courts, he appears regularly in venues in Southern Illinois, such as St. Clair County, Madison County and the United States District Court for the Southern District of Illinois in East St. Louis.

Mr. Nester has served as lead trial lawyer for several major lending institutions in numerous cases, including defending lender liability actions, interest accrual class actions, predatory lending class actions, breach of fiduciary and related trust cases, mortgage foreclosures, actions on notes and guarantees, replevin actions, security interest and related asset realization matters. He also has handled numerous cases involving real estate disputes, eminent domain and mechanic’s lien matters.

In addition to his substantial litigation practice, Mr. Nester practices in the area of real estate development, finance, land use, bankruptcy and construction. His real estate transactional experience includes acquisition and sales of hotels, shopping centers, cemeteries, office and service complexes, and leasing for both landlords and tenants, zoning, public and private finance, land development, reciprocal easement agreements and property management issues. Mr. Nester has counseled developers in connection with various land use issues, including appearing before various governmental and quasi-governmental entities for rezoning, variances, conditional use permits, annexations and other related matters in Illinois and Missouri.
