Antitrust Class Actions

Bryan Cave defends class action litigation in connection with a full range of antitrust issues.  These include allegations of monopolization and attempted monopolization (including predatory pricing, refusals to deal, and product bundling), resale restrictions (including pricing and customer and territorial restraints), price discrimination and arrangements among members of the same industry (including price-fixing, bid-rigging, group boycotts and information-sharing).

In defending these cases, lawyers in our class action group work closely with Bryan Cave’s antitrust lawyers, who have held senior positions with and have experience before federal antitrust enforcement agencies, as well as the Judiciary Committees of the Senate and the House of Representatives.

Our antitrust class action experience includes the following representative cases:
  • In re Mun. Derivatives Antitrust Litig. (S.D.N.Y.)  Represent municipal bond underwriter and broker, George K. Baum & Company, in multiple class actions presently consolidated in MDL proceedings, alleging bid-rigging in the municipal derivatives markets.
  • In re LTL Shipping Servs. Litig. (N.D. Ga.)  Represented Saia, Inc. in 52 class actions filed across the nation (many in California), which ultimately were consolidated by the JPML and transferred to an MDL proceeding in Georgia.  Succeeded in having all claims dismissed on the pleadings, prior to discovery.
  • Monsanto and Novus Int’l, Inc. (N.D. Cal.)  Defended multiple class and individual actions regarding an alleged international price-fixing cartel, and successfully opposed plaintiffs’ effort to consolidate cases within existing MDL proceedings.
  • In re Nat'l Ass’n of Music Merchants, Musical Instruments & Equip. Antitrust Litig. (S.D. Cal.)  Represent Fender Musical Instruments Corporation in 40 antitrust price-fixing matters that we took to the JPML and successfully had assigned to our judge of choice (over many objections) in the Southern District of California.  Initial dismissal motions pending.
  • Day. v. Taylor, 400 F.3d 1272 (11th Cir. 2005)  Represented the country's largest self-move truck rental organization in multidistrict alleged price-fixing cases.  Successfully moved to dismiss the claims in the Southern District of Florida and the Eleventh Circuit affirmed that dismissal.
  • Prime Care of Ne. Kan. v. Blue Cross Blue Shield of Kan. City (Dist. Ct. of Wyandotte Cnty., Kan.)  Represented Blue Cross in a class action brought by physicians, alleging price-fixing and other claims.
  • Yulga v. Pulte Home Corp. (D. Ariz.)  Defended private water company in two consolidated class actions that alleged consumer fraud and antitrust violations arising from an alleged conspiracy relating to delivery of water and sewer services in a new development north of Phoenix.  Class counsel asserted that damages exceeded $100 million.  Obtained dismissal of all claims.
  • In re Architectural Hinge Antitrust Litig. (E.D. Mo.)  Resolved criminal issues and successfully resolved federal direct purchaser treble damage class actions consolidated in Missouri.  Also resolved four state indirect purchaser class actions.
